These terms and conditions (the ‘Terms and Conditions”) govern the use of www.mountainmisfitco.com (the “Site”).
This Site is owned and operated by Sophie Bruce. This Site is an ecommerce website.
By using this Site, you indicate that you have read and understand these Terms and Conditions and agree to abide by them at all times.
About Us
Mountain Misfit Collective is based in British Columbia, Canada. All products are designed, produced, and/or fulfilled by us or our named local partners (including third-party print and fulfillment providers).
Products & Limited Editions
Many of our products are released as limited-edition drops with a fixed production quantity (e.g., "limited to 100"). Once a limited item sells out, we are under no obligation to restock it, though we may offer similar items in future collections.
Product photos are as accurate as we can make them, but slight variations in color, texture, or print placement may occur due to screen display differences, natural material variation, and the nature of hand-drawn/printed goods.
Pre-Orders
Some products are sold as pre-orders. By placing a pre-order, you acknowledge and agree that:

Your payment is processed at the time of order, not at the time of shipment, unless otherwise stated.

Estimated production and shipping timelines are our best good-faith estimate, not a guarantee. Delays can occur due to production, printing, or shipping partner timelines.

We will communicate any significant delays to the email address provided at checkout.
Pricing & Payment
We accept the following payments methods on our Site:
- Credit Card; and
- Debit.
When you provide us with your payment information, you authorize our use of and access to the payment instrument you have chosen to use. By providing us with your payment information, you authorize us to charge the amount due to this payment instrument. If we believe your payment has violated any law or these Terms and Conditions, we reserve the right to cancel or reverse your transaction.
All prices are listed in Canadian Dollars (CAD) unless otherwise stated and are subject to change without notice for future orders (changes do not affect orders already placed). Applicable taxes (GST/PST, where required) will be calculated and displayed at checkout. Payment is processed securely through our third-party payment processor; we do not store your full payment card details on our servers.
Shipping
When you purchase goods from out Site, the goods will be delivered through one of the following methods:
- Standard delivery 5-7 business days.
Shipping costs and estimated timelines are provided at checkout based on your delivery address. We are not responsible for delays caused by the shipping carrier, customs (for international orders, where applicable), or circumstances outside our reasonable control. Risk of loss and title for products pass to you upon our delivery to the shipping carrier. Please note that delivery times do not include weekends or Statutory Holidays.
You will be required to pay delivery charges in addition to the price for the goods you purchase.
You are required to provide us with a complete and accurate delivery address, including the name of the recipient. We are not liable for the delivery of your goods to the wrong address or wrong person as a result of you providing us with inaccurate or incomplete information.
Intellectual Property
All content published and made available on our Site is the property of Sophie Bruce at Mountain Misfit Collective. This includes, but is not limited to images, designs, photography, maps, logos, apparel designs and written content on this site are the original work of Mountain Misfit Collective and are protected by copyright. You may not reproduce, distribute, or use our designs or content for commercial purposes without our express written permission.
Acceptable Use
You agree not to use this site for any unlawful purpose, to attempt unauthorized access to our systems, or to interfere with the site's normal operation.
Limitation of Liability
To the fullest extent permitted by law, Sophie Bruce at Mountain Misfit Collective is not liable for any indirect, incidental, or consequential damages, claims, actions, losses, liabilities and expenses including legal fees arising out of your used on our Site or your violation of these Terms and Conditions.

Refund & Exchange Policy
We want you to love what you order.
Here's how returns and exchanges work for Mountain Misfit Collective products.
Limited Edition & Pre-Order Items
Because our drops are produced in limited, fixed quantities specifically based on pre-order demand, all pre-order and limited-edition sales are final, except in cases of damage, defect, or an error on our part (see below). We're unable to offer refunds or exchanges for change of mind on these items, since each drop is produced to match the exact number of orders received.
Damaged, Defective, or Incorrect Items
If your order arrives damaged, defective, or incorrect, please contact us within 4 days of delivery at mountainmisfitsco@gmail.com with:

A photo of the item (and packaging, if damage-related)
We will offer a replacement, store credit, or refund for the affected item, at our discretion, once the issue is confirmed.
Lost or Delayed Shipments
If your order hasn't arrived within the estimated shipping window, please contact us before reaching out about a refund - we'll help track it down with the shipping carrier first. Shipping delays caused by the carrier are outside our control, but we'll do what we can to help resolve the issue.
Non-Returnable Items
Due to their nature, the following are not eligible for return or exchange (outside of damage/defect):

How to Start a Return (Non-Limited Items, Where Applicable)
For any standard (non-limited, non-pre-order) items eligible for return, contact us at mountainmisfitsco@gmail.com within 7 days of delivery. Items must be unused, in original condition, and in original packaging. Return shipping costs are the responsibility of the customer unless the return is due to our error.
Refunds
Approved refunds will be issued to your original payment method within 5-7 business days of us receiving/confirming the returned or affected item.
